Salvador Cabanas, the Paraguayan football striker who suffered head injuries in a 2010 shooting in a Mexican bar, will file suit against Club America for breach of contract for suspending his pay, according to his lawyer Roberto Ruiz Diaz Labrano.
The announcement was made in an interview with the radio station “Radio Cardinal” in Paraguay.
Ruiz and Cabanas had hoped to take the case before mediation in the Mexican Football Federation (FMF). However, according to both, Club America did not want to resolve the issue of the contract with mediation.
They added that Michel Bauer, director of Club America, seeks to annul the contract since Cabanas quit working secondary to his accident. The annulment supposedly included the suspension of pay and is based on the argument that the injury was not work-related.
Ruiz states that he has proof that the lesions were “work-related” and reiterated his plan to take Cabanas case before FIFA.
Thelma Herrera is another lawyer specializing in sports who was interviewed separately. She declared that there is no case since the incident occurred outside of work hours.
Ms. Herrera also mentioned that Club America has already absorbed the costs of medical treatment for their player, as well as transporting him to his native Paraguay.
Cabanas was prominent in both Club America, a Mexican League team, and the Paraguayan National Soccer Team before he was shot in the head in the beginning of 2010.
The shooting incident left a bullet in the occipital lobe of Cabanas’ head. Cabanas was hospitalized and was able to be rehabilitated successfully until he was transferred to a clinic in Argentina to continue treatment.
Club America paid for the treatments and for the transfer to South America.
I remember that Club America once promised that they would be paying for his treatment for an indefinite time. I think Cabanas deserves justice and a resolution to his problem, but there should be an agreement about payment and treatment.
