JUST THE FACTS, MA’AM! 12/11/2020
Joe Friday, played by Jack Webb, in the TV shows Dragnet (1951-59). Joe Friday didn’t get to be a sergeant by beating around the bush. He wanted to get right to the heart of the matter, hence his famous catchphrase when interrogating female suspects: “Just the facts, ma’am.”
In a recent Miami Herald, a so called journalist, wrote about the news of the State of Florida’s joining Texas appeal to the SCOTUS alleging that four States broke the Constitution in the presidential election. I am not picking on Ms. Kirby Wilson, just using her as an example of the MSM’s attempt to disguise falsehoods and half truths as if they were factual instead of partisan propaganda favoring their favorite political views. These are in the immense majority tilted towards democrats and leftist ideology. Reversing Joe Friday’s question I am going to examine her news article vs. “just the facts, ma’am”.
She wrote; A Texas lawsuit which hopes to overturn Joe Biden’s win in the 2020 election.
Fact; The Texas lawsuit asks SCOTUS to correct the actions of officials in 4 States that changed the election rules just before it started, an action that ignored the States and the US Constitution, that establishes that the Legislature is the only one that has the right to make these changes. The result of this deed invalidated the votes of the citizens of the States that followed the law. To wit;
The Supreme Court has a very high appellate jurisdiction; it is the highest court of appeal. It can settle disputes between state and central governments, between two states and between citizens and state.
The United States shall guarantee to every State in this Union a Republican Form of Government. This clause, sometimes referred to as the Guarantee Clause, has long been at the forefront of the debate about the rights of citizens vis-à-vis the government. The Guarantee Clause mandates that all U.S. states must be grounded in republican principles such as the consent of the governed. By ensuring that all states must have the same basic republican philosophy, the Guarantee Clause is one of several portions of the Constitution which mandates symmetric federalism between the states.
In Luther v. Borden, the Court held that the determination of whether a state government is a legitimate republican form as guaranteed by the Constitution is a political question to be resolved by the Congress. In effect, the court held the clause to be nonjusticiable. The Luther v. Borden ruling left the responsibility to establish guidelines for the republican nature of state governments in the hands of the Congress.
For presidential elections, each state must appoint its electors to the Electoral College in a manner that complies with the Constitution. The Electors Clause requirement that only state legislatures may set the rules governing the appointment of electors and elections and cannot be delegated to local officials. The majority of the rushed decisions, made by local officials, were not approved by the state legislatures, thereby circumventing the Constitution. By ignoring both state and federal law, these states have not only tainted the integrity of their own citizens’ vote, but of Texas and every other state that held lawful elections.
The remedy that was suggested is to let the legislators decide the electors to be nominated.
She wrote; Biden won all four States and R’s and D’s have said the allegations were untrue.
Fact; The officials that denied the allegations were some of the same that changed the rules in the middle of the game. The statistics reflect what she called “irregularities” which were the increase in votes that was counted late at night and made Biden the winner. These “irregularities” happened in only 5 counties in the 4 States mentioned. The chances of the huge % of votes for one candidate when compared with the other 296 US counties, happening is one in quadrillions. This fact alone should give pause to everyone including journalists and a professional desire to investigate the discrepancies further.
She wrote; Attorney General William Barr said that “there is no evidence of voting irregularities that could have changed the election outcome”.
Fact; She conveniently, as most of the rest of the MSM, that Barr started his statement with “to date”, which would have changed the content of his declaration. To wit;
“To date, we have not seen fraud on a scale that could have affected a different outcome in the election,” Barr told The Associated Press. “Some media outlets have incorrectly reported that the Department has concluded its investigation of election fraud and announced an affirmative finding of no fraud in the election,” the spokesperson said. “That is not what the Associated Press reported nor what the Attorney General stated. The Department will continue to receive and vigorously pursue all specific and credible allegations of fraud as expeditiously as possible.”
She wrote; I will skip all the attorney’s opinions she cited as they all agreed, an action unheard of in the legal judgment reality! She wrote that Trump had blamed his loss to Biden on fraud without citing any credible evidence.
Fact; There is ample evidence including ten’s of thousand affidavits ( legal evidence), video’s and data that has sufficient indications of wrongdoing. This allegations are important enough that merits impartial investigating. Instead she writes the words “not credible” which is just an opinion not evidence.
I could go on and on, but it would be a repetition of what is obvious, that Trump faces a cabal that not only includes the opposing party, but also the media, the tech. companies, Hollywood and other celebrities, and many in Wall Street, plus most politicians that are referred to as “the swamp”.
Regardless of SCOTUS/Texas final outcome the truth will eventually be known and unfortunately it will not be pretty! It will, I believe, include not only many in our country’s establishment, but some international enemies like China, Russia and Iran.
